End User License Agreement

Carefully read the following terms and conditions before using the Software. This license is a contract between you (hereafter, the Customer) and South Wedge Software, LLC (hereafter, the Company) regarding the use and/or sale of PhotoNote and accompanying data files and documentation (hereafter, the Software). Unless the Customer has a different license agreement signed by the Company, use of this software indicates acceptance of this license agreement and warranty. If the Customer does not accept these terms the Customer must cease using this software immediately.

Evaluation and Registration
The Software provides a non-exclusive free trial (the “Trial License”) with limited functionality. The free trial watermarks the display and file output. The Customer may convert the Trial License to a fully functional license (the “User License”) by purchasing a User License from South Wedge Software. Registering the software with a Version 2 License Key will unlock the full functionality and remove watermarks.

One registered copy of the Software may either be used by a single person who uses the software personally on one or more computers, or installed on a single computer used by multiple people, but not both.

Distribution
Provided that the Customer does not include a License Key the Customer is hereby licensed to make copies of the Software; give exact copies of the original to anyone; and distribute the Software in its unmodified form via electronic means. The Customer is specifically prohibited from charging for any such copies.

Governing Law
This agreement shall be governed by the laws of the State of New York.

Disclaimer of Warranty
THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED. ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO REFUND OF PURCHASE PRICE OR CORRECTION OF THE DEFECTIVE SOFTWARE.
